Fertility Clinic Switches Sperm Samples, Conceals its Actions for Over 20 Years

Attorneys Daniel E. O'Brien and Bart J. Galvin are pursuing a lawsuit in the Circuit Court of Cook County on behalf of a family that suffered harm due to the negligence of a fertility center. Our clients, known as John and Jane Doe, received treatment from Fertility Centers of Illinois in 1997 and 1998. John Doe provided a sperm sample that would be used to impregnate Jane Doe via artificial insemination. However, unbeknownst to the couple, the fertility clinic switched John Doe's sample with that of another patient. The couple had a son in 1999, but they did not find out that he was not the biological child of John Doe until the family performed a DNA test through a geneology service over 20 years later.
The lawsuit alleges that the clinic intentionally concealed the fact that Jane Doe was inseminated with the wrong sperm sample. Our attorneys are working with the family to seek damages from Fertility Clinics of Illinois for negligence, breach of contract, lack of informed consent, infliction of emotional distress, and fraudulent concealment.
